 I don't follow your logic here. What does the timing of the warnings have
 to do with whether it's an attack?

 Anybody can cause these warnings to appear, just by sending a sending cell
 before you've received 100 relay data cells from that relay yet.

 I wonder if Orchid (the Java Tor client) is doing this.
