I think that other than some bad publicity (though many companies will argue 
there's no such thing) this will be little more than an inconvenience for 
those involved. You have a larger chance that MS Windows has to be pulled 
because of copyright infringement than Linux. Any proprietary code in the 
kernel (if any) will be replaced before you notice it's there in the first 
place...
