Your comment was about Novell, mine was about MS. The behavior of both is dubious.
There is nothing new or surpricing about MS' part but what is
surpricing and disappointing is Novell (we thought to be a friend of
the foss community) joining hands with MS to stab the community.
It also makes it easy for MS to validate their claims for patent
infringements (for example in a court case against another
distribution or project) as they can point out Novell as an example
who agreed to their claims and accepted to pay royalties for using
their patents.
It also help MS' crusade against foss as they can show Novell as an
alernative to their offering if and when ant-trust case comes against
them. It also help them in cases against them in EU for lack of
interoparibility.
