While forensics can now splice into your power supply and
remove the server while it's still running (because otherwise
a crypto fs which needs a passphrase at boot would make
the confiscation quite useless), but of course they will
have to separate the system from the network, including
access to local heartbeat-like services.

Either way you'll notice your server is down, even if you don't
