Do you see the fallacy there?

It is *illegal* to falsely yell "Fire!" in a crowded theater. But
there are *no technical measures* in place to prevent you from
actually doing so.

Same goes with Tor. It may be illegal to do X according to judicial
framework Y, but Tor does not technically prevent you from doing it
anyway.
