I don't agree. First off, there should be no need to clip in the first place
because silkscreen should never cross solder areas in the first place.
If they do it is because of bad placement of legends or improperly
designed elements.

The main reason I chose to clip to the pad is because it is much simpler to
do it that way in the code (mainly for on-screen display). However, it fully
serves the needed function for those who (a) fab with a vendor that
doesn't do their own clipping and (b) have a bad layout in the first place.

Lastly, it's probably what the designer wanted when they made the bad
layout. They chose to put silkscreen where it didn't belong - presumably
they'd like to keep as much of the silk as possible.
